COVID-19 Liability Waiver

I acknowledge the contagious nature of the Coronavirus/COVID-19 and that while The Manhattan Community Squash Center (“MCSC,” owned and operated by the The Squash Center, Inc.) has undertaken substantive efforts to mitigate the risk of infection on premises, it can not guarantee that I will not become infected with the Coronavirus/Covid-19 in connection with being on premises at the MCSC.  Accordingly, I understand and fully accept the risk of becoming infected in connection with being on premises at MCSC (whether the result of the actions, omissions, and/or negligence of myself and/or others, including but not limited to MCSC staff and/or MCSC members or guests and their families). I also acknowledge that my being on premises at MSCS is completely voluntary.

With connection to my own medical condition, I attest that I have not been diagnosed with Coronavirus / COVID-19, and have no reason to believe I am currently infected by Coronavirus / COVID-19 and further that:

  • I am not experiencing any symptoms of infection such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
  • I have not traveled internationally or to a highly impacted US area within the last 14 days.
  • I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
  • I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19. 

 

I understand that I should not enter MCSC premises if I cannot make the above attestations.  

Formal release and indemnity.  I hereby fully release and agree to hold harmless MCSC from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act, or that may otherwise arise in any way in connection with being on premises at MCSC and/or participating any activities on premises – including any damages or losses related to Coronavirus/COVID-19. I understand that this release discharges MCSC from any liability or claim that I, my heirs, or any personal representatives may have against MCSC with respect to same. This liability waiver, release and indemnity extends to MCSC together with its owners (i.e., The Squash Center, Inc.), its Board and staff and its partners.  Lastly, I agree to fully indemnify MCSC with respect to all claims and losses alleged by a third party against MCSC as a result of my actions.
